Test Ride Agreement & Liability Waiver

Please read carefully before proceeding with your test ride.

WARNING: Burchda e-bikes are high-performance vehicles. Many of our models feature dual motors, fat tires, and power outputs ranging from 1500W up to 5000W, resulting in rapid acceleration and high top speeds. You MUST be 18 years of age or older to participate. Proper safety gear and extreme caution are strictly required.

1. Age Requirement & Medical Fitness

I represent and warrant that I am at least 18 years of age. I acknowledge that operating a high-performance e-bike requires physical coordination and balance. I certify that I have no physical or mental medical conditions (including but not limited to heart conditions, vision impairment, or balance disorders) that would impair my ability to safely operate the e-bike. In the event of an injury, I authorize the Host or Burchda Bikes to secure emergency medical treatment on my behalf, and I agree to be solely responsible for all associated medical costs.

2. Assumption of Risk

I acknowledge and understand that riding an electric bicycle, particularly high-power, high-torque models manufactured by Burchda Bikes, involves inherent risks, dangers, and hazards. These include, but are not limited to: falls, collisions with pedestrians, vehicles, or other objects, loss of control due to rapid acceleration, terrain conditions, and mechanical failure. I fully assume all responsibility for any such risks, whether known or unknown, resulting from my participation in this test ride.

3. Safety and Compliance

I agree to wear a properly fitted and fastened helmet at all times during the test ride. I agree to follow all instructions provided by the Burchda Brand Ambassador (the "Host") and to abide by all local, state, and federal traffic laws and regulations. I agree not to operate the e-bike while under the influence of alcohol, drugs, or any medication that may impair my judgment.

4. Release of Liability

In consideration for being permitted to test ride the equipment, I, on behalf of myself, my heirs, executors, and assigns, hereby release, waive, and fully discharge Burchda Bikes, its officers, employees, agents, and the Brand Ambassador (Host) providing the bicycle, from any and all claims, liabilities, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, while participating in the test ride.

5. Indemnification (Hold Harmless)

I agree to indemnify, defend, and hold harmless Burchda Bikes and the Host from and against any and all claims, demands, lawsuits, judgments, losses, or expenses (including reasonable attorneys' fees) arising out of or resulting from my actions or negligence during the test ride, including but not limited to any property damage or personal injury caused to third parties (e.g., pedestrians, other vehicles).

6. Equipment Condition and Damage

I agree to inspect the e-bike prior to riding and notify the Host of any apparent defects. I accept the equipment "as is." I agree to ride exclusively in safe, open environments as directed by the Host. I agree to be held financially responsible for any damages to the Burchda e-bike caused by my negligence, reckless riding, or intentional misconduct.

7. Severability

I agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the state in which the test ride occurs. If any portion of this agreement is held invalid or unenforceable, the remaining provisions shall continue in full legal force and effect.

By signing the form below, I acknowledge that I am 18 years of age or older, that I have read this Agreement and Liability Waiver, fully understand its terms, and agree to be legally bound by them.
