Ambassador Program Terms & Conditions

By applying to and participating in the Burchda Bikes Brand Ambassador Program, you agree to comply with and be bound by the following terms and conditions.

1. Independent Contractor Status

You agree that your participation in the Ambassador Program does not create an employer/employee relationship, franchise, agency, or partnership between you and Burchda Bikes. You are acting as an independent contractor. You have no authority to bind Burchda Bikes into any agreements or make representations on our behalf beyond providing your referral link and sharing personal experiences.

2. Commissions and Payouts

Ambassadors earn a commission for every successful, non-returned referral order placed using their unique referral link or promo code.

  • Structure: Commissions are tiered based on your total successful referrals (e.g., 5% for the Starter tier, 8% for the Pro Rider tier). Specific tier requirements and milestone bonuses are outlined in your Ambassador Dashboard.
  • Payout Schedule: All commissions are calculated at the end of each month and paid out via PayPal within the first week of the following month.
  • Exclusions: Commissions are not paid on canceled, refunded, or fraudulent orders. Self-referrals are strictly prohibited and will result in immediate termination from the program.

3. Hosting Test Rides & Safety Protocols

If you choose to host local test rides for prospective buyers, you acknowledge that our e-bikes are high-performance vehicles. You agree to:

  • Conduct all test rides in safe, open, and legal environments.
  • Mandatory Waiver: Ensure that every test rider signs the official Burchda Digital Liability Waiver before operating the e-bike. Failure to collect a signed waiver will hold you fully liable for any incidents.
  • Require all riders to wear a fastened helmet.

4. FTC Disclosure Requirements

As an Ambassador, you are required by the Federal Trade Commission (FTC) to transparently disclose your relationship with Burchda Bikes. When sharing your referral link or promoting our products on social media, blogs, or videos, you must clearly state that you earn a commission from purchases. Use clear hashtags such as #BurchdaAmbassador, #Ad, or #Sponsored in your posts.

5. Prohibited Marketing Activities

To protect the integrity of the Burchda brand, the following activities are strictly prohibited:

  • Bidding on trademarked terms (e.g., "Burchda", "Burchda Bikes") in Google Ads or other pay-per-click (PPC) campaigns.
  • Posting your referral code on public coupon/deal websites (e.g., RetailMeNot, Honey).
  • Spamming social media groups, forums, or email lists.
  • Making false performance claims about our e-bikes.

6. Termination

Burchda Bikes reserves the right to suspend or terminate your Ambassador account at any time, with or without cause, especially in cases of policy violation, brand disparagement, or fraudulent referral activity. Upon termination, any pending, legitimately earned commissions will be paid out, but your referral links will be immediately deactivated.
